Establishing Paternity

Establishing paternity is the legal term for determining the father of the child. If the parents are married when the child is born, the husband is the legal father noted on the child’s birth certificate. If the parents are not married when the child is born, paternity must be established in order to create the same legal relationship between parents and children. A father can sign a “voluntary acknowledgement” if he agrees that the child is his. If he does not agree, DNA testing can be ordered to determine whether a legal relationship exists.  This is scientifically done by comparing “mouth” swabs from the mother, child and potential father.

It also enables a parent to obtain health insurance for the child if it is available through an employer and protects the child’s rights to benefits in the event of the father’s death – such as money or property left in a will, veterans’ benefits or Social Security Benefits.
